So what does that mean in practice?

Councils remain in control

While many Local Buy Arrangements include pre-agreed Purchaser Conditions of Contract (LB PCCs), councils always retain full discretion over the contract conditions applied.

That means when procuring through a Local Buy Arrangement, councils can choose to:

  • Use the LB PCCs as issued
  • Apply council-specific special conditions to the LB PCCs
  • Use their own council contract conditions
  • Adopt alternate frameworks such as industry-standard contracts

Regardless of the option selected, councils still access the benefits of procuring within the Local Buy Arrangement framework.

Why many councils choose the default Local Buy PCCs

For many procurement activities, the default LB PCCs offer a practical, efficient pathway that can reduce administrative effort and accelerate project delivery.

Key benefits include:

  • Pre-agreed terms with suppliers - reducing the need for repeated legal review 
  • Faster contracting - helping suppliers mobilise sooner 
  • Reduced negotiation costs - for both councils and suppliers 
  • No royalty or licence fees - including access to Local Buy’s construction contract suite 

What suppliers are telling us

Supplier feedback consistently shows a preference for procurements using Local Buy Arrangements, particularly where the default LB PCCs are used.

Why? Because standardised conditions can reduce duplication, lower legal and commercial review costs, and allow suppliers to focus on delivery and competitive pricing.

In high-volume procurement environments, this can also improve supplier participation and capacity.

When council-specific contracts may be appropriate

There are circumstances where councils may choose to apply their own conditions of contract or alternate frameworks, including:

  • Governance or policy requirements 
  • Funding or regulatory obligations 
  • Higher-risk or complex procurements 
  • Specialised scopes requiring bespoke risk allocation 

The important point: councils can still procure through the Local Buy Arrangement while applying the contract framework that best fits their needs.

A critical audit and governance reminder

For internal governance and external audit purposes, councils should ensure the relevant Local Buy Arrangement number and applicable contract conditions are referenced throughout the procurement process, including RFQs, contracts, purchase orders and invoicing.

This supports transparency, audit readiness and compliance with local government procurement requirements.
